Diese Nutzungsbedingungen gelten für die Mobile App „G-Stint“ der KWS18. Die App ist kostenlos und befindet sich noch in Entwicklung. Mit der Installation und Nutzung der App akzeptierst du diese Bedingungen.
Die App ist zur privaten, nicht-kommerziellen Nutzung bestimmt. Die Rechte an der App und ihren Inhalten verbleiben bei KWS18. Ein Anspruch auf Verfügbarkeit, bestimmte Funktionen oder den Fortbestand der Entwicklungsphase besteht nicht: Funktionen können sich jederzeit ändern.
Verkehrsregeln haben immer Vorrang. Richte die App nur bei stehendem Fahrzeug ein oder starte und beende Aufnahmen über eine:n Mitfahrende:n. Bediene das Gerät niemals selbst während der Fahrt. Verwende eine fachgerecht befestigte, die Sicht nicht einschränkende Halterung (vgl. § 23 StVO) und nimm das Gerät während der Fahrt nicht in die Hand.
Die Nutzung erfolgt in eigener Verantwortung. Ablenkung im Straßenverkehr gefährdet dich und andere. Im Zweifel: nicht nutzen.
Die in der App angezeigten G-Kräfte, Geschwindigkeiten und Statistiken sind unverbindliche Anzeigewerte aus Consumer-Sensoren. Sie sind nicht kalibriert, nicht geeicht und nicht für Beweiszwecke, Versicherungs- oder amtliche Zwecke geeignet.
Die App wird „wie sie ist“ ohne Gewährleistung bereitgestellt. Es können Fehler auftreten; es besteht die Möglichkeit von Datenverlust. Nutze deshalb die Backup-Funktion (EINSTELLUNGEN → BACKUP). Da alle Fahrtdaten ausschließlich auf deinem Gerät liegen, ist KWS18 nicht für deren Verlust verantwortlich.
KWS18 haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie bei Verletzung von Leben, Körper oder Gesundheit. Im Übrigen haftet KWS18 nur für die Verletzung wesentlicher Pflichten aus diesem Nutzungsverhältnis und begrenzt auf den vorhersehbaren, typischen Schaden.
KWS18 kann diese Nutzungsbedingungen anpassen; die aktuelle Fassung findest du in der App unter EINSTELLUNGEN → RECHTLICHES. Es gilt deutsches Recht, soweit zulässig; zwingende Verbraucherschutzvorschriften des Landes deines gewöhnlichen Aufenthalts bleiben unberührt. Fragen: [email protected].
These terms of use apply to the “G-Stint” mobile app by KWS18. The app is free and still in development. By installing and using the app you accept these terms.
The app is intended for private, non-commercial use. All rights to the app and its content remain with KWS18. There is no entitlement to availability, specific features or the continuation of the development phase: features may change at any time.
Traffic rules always take priority. Set up the app only while the vehicle is parked, or start and stop recordings via a passenger. Never operate the device yourself while driving. Use a properly mounted holder that does not obstruct your view (cf. § 23 StVZO) and do not pick up the device while driving.
You use the app at your own risk. Distraction in traffic endangers you and others. If in doubt: don’t use it.
The G-forces, speeds and statistics shown in the app are non-binding display values from consumer sensors. They are not calibrated, not certified and not suitable for evidentiary, insurance or official purposes.
The app is provided “as is”, without warranty. Errors may occur; data loss is possible; that is what the backup feature is for (SETTINGS → BACKUP). Since all drive data lives exclusively on your device, KWS18 is not responsible for its loss.
KWS18 is liable without limitation for intent and gross negligence as well as for injury to life, body or health. Otherwise, KWS18 is liable only for the breach of essential obligations under this relationship of use, limited to the foreseeable damage typical for this type of contract.
KWS18 may amend these terms; the current version is available in the app under SETTINGS → LEGAL. German law applies to the extent permissible; mandatory consumer protection provisions of your country of residence remain unaffected. Questions: [email protected].
